I'm happy with the contract, do I need to take legal advice?
No two franchise contracts are exactly the same and you need to be absolutely certain that you understand every clause, which is why we strongly suggest that you have a legal professional explain the contract to you.
My friend knows about the law. Can he advise me?
Of course, you can take advice from whoever you wish, but any firm of solicitors locally is likely to offer the service.
Why do I have to wait seven days before signing the contract?
It is very important to us that you make the decision to take a franchise for the right reasons and without pressure.
If I have questions can I phone you during those seven days?
We would prefer not to have any contact with you in the cooling down period so that we cannot unduly influence your decision.
I would like to examine the contract in more detail, can I have it for longer?
Yes, of course. . . but remember that we cannot reserve a territory beyond seven days.
Can I reserve my territory without attending an experience day?
An experience day has two purposes. . . it allows you to see a mail centre working, but also give us an opportunity to meet and assess you as a potential franchisee, so you would still need to visit Philbeach.
I'm not sure I can commit to 5 years, so could I buy the franchise for 2 years instead?
Unfortunately not. Customers quickly become dependent on the accommodation address that your mail centre provides and would face enormous inconvenience, and cost, if they were required to change the address with their banks, building societies, insurance company, card issuers, the DVLA etc. and all of their other correspondents.
I don't know the Data Protection Act. . . what is a Data Controller?
A Data Controller is the individual within a Company, in this case Expost Holdings Ltd., responsible for the security of all customers' personal data and legal compliance with the Act.
What happens if I make a mistake. . . will I lose my franchise?
We all make mistakes and it is extremely unlikely that any genuine error would result in a breach of contract so severe that we would consider a withdrawal of the franchise.
Can I relinquish my franchise before the 5 years?
When you sign the contract you are committing to a five year term, not just with us. . . but with every one of your customers! An early withdrawal and loss of your mail centre address would damage our brand reputation and potentially expose you to the risk of legal action by your customers with whom you have contracted to provide the service.
There are several actions we can take to reduce the impact of this situation, but each will require your active co-operation.
What happens if I become ill or die?
If you are incapacitated, we can take similar steps to placate your customers but, in the event of your demise, we would need the co-operation of your surviving partner, relative, or executors of your estate in order to do so.
Can I sell my franchise during the 5 year term?
One of the actions that we will take in the event that you wish to terminate your contract early is to try to secure a new franchisee for the territory.
I would like to sign up for 10 years. Can we do that?
The term of our franchise contract is fixed at 5 years, but can be extended for a further five years within six months of the current contract expiring.
What happens to the equipment at the end of the franchise?
All of your franchise hardware, including the PC, belongs to you. . . so you may do with it as you wish. The only things you are not able to retain are customer data and any copies of the Operating Manual that you may have made.
Can I keep the equipment and set up my own mail business?
Of course not! :o) Your contract includes a restrictive covenant that explicitly bars you from owning, running or working within, any other mail or logistics business for 24 months after the termination of your contract.
Can I change my launch date after I have signed the contract?
Yes, but subject to the availability of training spaces.
I have an Ebay shop. Can I use the bags, label printer and Royal Mail account to despatch my parcels?
You may use the consumables that are included in your initial franchise package as you see fit; but remember that you'll need to replenish supplies at some point in the future. You can also use our Royal Mail on-line account to send your own parcels and the system will automatically reconcile their postage charges at month's end.
Do I have to buy more consumables from expost?
Not at all. . . we are not in the business of selling stationery! :o) All we insist upon is that you purchase any necessary consumables from an authorised supplier to ensure a consistant quality.
Can I run my own promotions to develop my franchise?
Online sales and marketing is our area of expertise and we will generate all the sales needed to grow your business. . . but we have several campaigns planned in which you can actively participate, if you wish!
